A recent survey of REALTORS® reveals that ten to fourteen percent of pending sales don't get to closing, while another twenty percent experience unplanned delays before being finalized.&lt;br /&gt;&lt;br /&gt;Delays fall into three major categories: financing, title research, and inspections.  Getting estimates and negotiating repairs can really hold up a transaction, but there are ways to speed up the process.&lt;br /&gt;&lt;br /&gt;One option is for sellers to procure a pre-listing inspection and make repairs before the first potential buyer sets foot in the home.  However, this can be a costly expense for sellers, especially when buyers will almost certainly hire their own inspector after making an offer, and there can often be great differences between two inspection reports.&lt;br /&gt;&lt;br /&gt;A better alternative is for the listing agent to walk through the home with the sellers, noting the age and the condition of major components of the home and securing estimates for potential repairs.  Sellers may not have to fix the problems, but having an idea of the cost of repairs will help them price the home fairly, as well as reduce the time necessary for buyers to negotiate the costs. Here are suggestions for both situations.&lt;br /&gt;&lt;br /&gt;If you're facing a deadline due to job relocation or other reasons, then you need to price competitively, even more competitively than expected in today's market.  You'll need to list at significantly less than your competition.  Think 15% less.  That may seem tough to stomach, but it’s better than continuing your monthly loan payments or the hassle of trying to find tenants to rent your home.&lt;br /&gt;&lt;br /&gt;If your home has been listed for some time, but not generating interest, you'll need to lower your price.  Of the three elements that sell a home - price, location, and condition - price is the one you'll have the most control over.&lt;br /&gt;&lt;br /&gt;If home values have declined in your neighborhood, the price you originally listed at a few months ago may now be too high and out of line with comparable listings. I heard that the rules regarding smoke detectors are changing. What are these changes and how do they impact me and my clients?&lt;BR&gt;&lt;br /&gt;&lt;br /&gt;A. What you heard is true. On April 5, 2010,* a new regulation regarding the installation and maintenance of smoke detectors will&lt;br /&gt;become effective. These new regulations were enacted by the Massachusetts Department of Fire Services and will apply to single and&lt;br /&gt;multi-family homes built (or most recently renovated) before 1975.&lt;BR&gt;&lt;br /&gt;* Note: April 5, 2010 is the new effective date. The original effective date was January 1.&lt;BR&gt;&lt;br /&gt;&lt;br /&gt;For homes sold on or after April 5, 2010: The regulations require two different types of smoke detectors to be in place depending&lt;br /&gt;upon the location in the home. First, in zones within 20 feet of a kitchen or bathroom, smoke detectors using photoelectric only&lt;br /&gt;technology will be required. Outside of the 20-foot kitchen &amp; bath zone(s), the regulations require smoke detectors using both&lt;br /&gt;ionization and photoelectric technology to be installed.* Compliance can be achieved by installing either dual technology&lt;br /&gt;("combination units") or by installing separate ionization and photoelectric units. Again, all smoke detectors within 20 feet of a&lt;br /&gt;kitchen or bath must be photoelectric ONLY.&lt;BR&gt;&lt;br /&gt;&lt;br /&gt;* Note: The regulation was recently amended to provide an exemption from the ionization sensor requirement for&lt;br /&gt;homes w/ low-voltage alarm systems (due to product availability problems).&lt;br /&gt;These requirements were developed, in part, based upon research that shows that ionization smoke detectors tend to give false alarms&lt;br /&gt;due to fumes given off from typical cooking activities or steam from a shower. Frequent false alarms often lead residents to disable&lt;br /&gt;smoke detectors by removing their batteries. The intent of the new regulations is to make homes safer by preventing residents from&lt;br /&gt;disabling smoke detectors that are triggered by typical cooking or bathing activities.&lt;BR&gt;&lt;br /&gt;&lt;br /&gt;Q. What about battery-operated smoke detectors? Do they comply with the new regulations or, must the units be hard-wired?&lt;BR&gt;&lt;br /&gt;&lt;br /&gt;A. The battery/hard-wire rules are not changing at the State level. Statute specifically provides that "… the head of the fire&lt;br /&gt;department shall allow the installation of approved monitored battery powered smoke detectors." They said they emailed me? How can that be with all my electronic connections to get my email whenever, wherever I am? Well, Super Hubby jumped to the rescue and off to the mall he went! He said he's not coming home until he finds that item. I sure hope to see him for Christmas!&lt;br /&gt;&lt;br /&gt;Anyway...we all spend way too much time in front of our computer screens, internet phone screens, TV screens, GPS screens, etc. I think you're getting the picture. Complete information on how the first time homebuyer tax credit works, including the eligibility requirements for the tax credit, the amount of the tax credit that a first-time homebuyer may be eligible to receive, and how a homebuyer may claim the tax credit is available on the IRS website at http://www.irs.gov/newsroom/article/0,,id=204671,00.html?portlet7.  &lt;br /&gt;• Guidance on how FHA-approved mortgagees and FHA-approved nonprofit organizations as well as Federal, state, and local government agencies or instrumentalities may assist homebuyers that are eligible for the tax credit.&lt;br /&gt;I.  About the First-Time Homebuyer Tax Credit&lt;br /&gt;&lt;br /&gt;Please check the IRS website to ensure you have up-to-date information.  A brief overview of the tax credit from the IRS website and a copy of IRS Form 5405 (including instructions) are attached for reference.&lt;br /&gt;&lt;br /&gt;Pursuant to 31 U.S.C. 3727 and 26 U.S.C. 6402, a refund of the first-time homebuyer credit will be made by the IRS only to the taxpayer, not to a third party.  In other words, any refund issued in response to a claim for this credit cannot be assigned by a taxpayer to a third party.&lt;br /&gt;II. FHA Tax Credit Guidance&lt;br /&gt;&lt;br /&gt;Secondary Financing  &lt;br /&gt;&lt;br /&gt;Consistent with existing FHA policy, FHA will permit entities covered by Section 528 of the National Housing Act to use the current authority to offer tax credit advances with second liens in a manner consistent with the requirements in 12 U.S.C. 1709(b)(9).  Eligible government agencies and instrumentalities of government are described in handbook HUD-4155.1 5.C3 and 5.C4. &lt;br /&gt;&lt;br /&gt; &lt;br /&gt;Conditions:&lt;br /&gt;• The tax credit advance, when combined with the FHA-insured first mortgage may not result in cash back to the borrower.  &lt;br /&gt;• The second lien may not exceed the total amount needed for the down payment, closing costs, and prepaid expenses.&lt;br /&gt;• Secondary financing may be “soft” (silent) or require a monthly repayment.  &lt;br /&gt;• If payments are required, they must be included within the qualifying ratios and, when combined with the first mortgage, cannot exceed the borrower’s reasonable ability to pay.   &lt;br /&gt;• Payments must be deferred for at least 36 months to not be included in the qualifying ratios.&lt;br /&gt;• If the tax credit advance loan has a short term for repayment, it must also provide that if the borrower fails to repay by the designated deadline, principal and interest payments begin automatically or the loan converts to a “soft” second.&lt;br /&gt;• The secondary financing may not require a balloon payment before ten years.  &lt;br /&gt;&lt;br /&gt;Purchase of Tax Credit&lt;br /&gt;&lt;br /&gt;FHA-approved mortgagees and FHA-approved nonprofit organizations as well as Federal, state, and local governmental agencies and instrumentalities thereof may purchase the tax credit anticipated by the homebuyer.  &lt;br /&gt;&lt;br /&gt;Conditions:&lt;br /&gt;• The proceeds of the sale of the tax credit may not exceed the anticipated tax credit due the homebuyer based on the computations of form IRS 5405;&lt;br /&gt;• The borrower must submit a signed certification that the tax credit is not subject to offset due to other indebtedness.&lt;br /&gt;• A copy of the borrower’s tax refund and/or the IRS 5405 must be collected and retained in the FHA case binder.  &lt;br /&gt;• Any costs attendant to the purchase of the tax credit are to be nominal and discounting the anticipated credit to cover the costs and expenses of the transaction must be reasonable and disclosed to the homebuyer.  In FHA’s view, fees and costs that total more than 2.5% of the anticipated credit are considered excessive.  (Example:  $6000 to be refunded, with all fees and costs discounted, borrower should receive not less than $5850.00 for sale of tax credit.)&lt;br /&gt;• Pursuant to 12 U.S.C. 1709(b)(9), the homebuyer’s downpayment required for eligibility for FHA insurance may not consist of any funds (including funds derived from a sale of the homebuyer tax credit) provided by the mortgagee, the seller, or any other person or entity that financially benefits from the transaction (or by any third party or entity that is reimbursed, directly or indirectly, by the financially benefiting person or entity).  Accordingly, the proceeds of the sale of the tax credit to FHA approved mortgagees, the seller, or any other person or entity that financially benefits from the transaction (or any third party or entity that is reimbursed, directly or indirectly, by the financing benefiting person or entity), may not be used to meet the 3.5% minimum downpayment, but may be used as additional downpayment, buying down of interest rate, or other closing costs.&lt;br /&gt;&lt;br /&gt;Due Diligence&lt;br /&gt;FHA expects that entities purchasing tax credit assets will employ appropriate due diligence measures including, but not limited to:&lt;br /&gt;• Require the homebuyer to draft and provide the IRS form 5405 “First-Time Homebuyer Credit.”&lt;br /&gt;• Contact the borrower’s employer and review pay stubs to confirm there are no outstanding garnishments.&lt;br /&gt;• Review the homebuyer’s credit report to ensure there are no unpaid student loans, or other obligations that could be offset against the credit.&lt;br /&gt;• Validate that all of the eligibility requirements for the tax credit are fulfilled &lt;br /&gt;• Review previous tax returns and IRS tax assessment letters, if any, to determine that the borrower does not have unsettled obligations to the IRS &lt;br /&gt;&lt;br /&gt;III.  Monitoring &lt;br /&gt;&lt;br /&gt;In order to track the tax credit monetization activities, FHA will require FHA-approved mortgagees to input into FHA Connection the following data:&lt;br /&gt;• Name and EIN of the party who purchased the tax credit, &lt;br /&gt;• The amount of the anticipated credit, and&lt;br /&gt;• The amount the homebuyer paid for the monetization services.&lt;br /&gt;&lt;br /&gt;The lender must also collect and maintain in the FHA case file the documentation that validates all of the tax credit monetization data submitted via FHA Connection.  &lt;br /&gt;&lt;br /&gt;FHA will monitor the purchase of tax credit transactions closely.  Charging of excessive fees or costs in the purchase of the tax credit or increasing other fees or charges in the transaction without FHA approval may result in referral to the Mortgagee Review Board, and particularly with respect to entities that are not FHA-approved mortgagees, referral to the Federal Trade Commission, or referral to the appropriate State Attorney General office, as may be applicable. &lt;br /&gt;&lt;br /&gt;If you have any questions regarding this mortgagee letter, please call FHA’s Resource Center at 1-800-CALL-FHA (1-800-225-5342). The stability of knowing where you’re going to return to every day/night after work and the ability to make it your own. A garden to grow your own vegetables, a yard for a pool, swingset, or the safety of your pets.  It has always been one of the best investments you could make over the years and most of retirement wealth comes from selling one’s primary residence and the tax free benefit. ($250,000 single and $500,000 married if you’ve lived in the home at least 2 of the previous 5 years).&lt;br /&gt;&lt;br /&gt;Home values will continue to decrease and will ultimately drive down prices to allow economic affordability. This trend will continue through 2010 and the recovery beyond that will go hand in hand with the economy instead of our past experience of doubling and tripling every few years.&lt;br /&gt;&lt;br /&gt;With all that said…interest rates are rumored to be falling to 4.50% very soon! There are some great opportunities out there and buyer's are recognizing that fact and acting..Pending home sales were higher than year-earlier levels for the second straight month -- 1.6 percent higher than September 2007 . Western States are now reporting pending sales at 39.7 percent higher than there were in September 2007.&lt;br /&gt;&lt;br /&gt;Chief economist Lawrence Yun, spoke at the National Association of Realtors convention in Orlando recently and warned not to expect a housing recovery overnight, certainly not with unemployment on the rise. But he projected a "slow, steady, multi-year upward trend, with 5.02 million total sales this year, 5.3 million for 2009, and 5.6 million for 2010."&lt;br /&gt;&lt;br /&gt;So, if you're trying to predict the bottom to jump into the market...Hmmm. I've been selling homes and assisting with financing for 30+ years and thought I'd seen it all. WRONG..&lt;br /&gt;&lt;br /&gt;&lt;br /&gt;&lt;br /&gt;As Lyndon Johnson said, "We can draw lessons from the past but we cannot live in it."&lt;br /&gt;&lt;br /&gt;&lt;br /&gt;&lt;br /&gt;New financing guidelines and FHA loans have turned us all upside down and inside out asking for documentation one paper at a time! You put a nice clean financing package together, send it to FHA for their final sign off, they take 10 days to review the file and then send it back looking for one piece of paper. You quickly send that in. They take another 10 days to re-review the file and send it back looking for one more piece of paper. Frustrated, you send that in quickly and 10 days later they ask you for another! Call me silly but wouldn't it be easier to ask for all of them at once or would that be taking the power away from the powers that be!&lt;br /&gt;&lt;br /&gt;&lt;br /&gt;&lt;br /&gt;We actually had to hold up a closing at the closing table because they would not fund the loan until they had approval from the next investor they were selling the loan to. This was a local banking institution and the client went to the local bank to have their loan local instead of using a mortgage broker/company because they thought their loan would be sold. Lesson well learned. Make sure to ask if they are going to sell you before you close or hold you hostage at the closing table while they scurry around looking for a buyer for your loan!  This seems a little backwards to me but again, we can't live in the past.&lt;br /&gt;&lt;br /&gt;&lt;br /&gt;&lt;br /&gt;They are covering every angle and making buyers and sellers jump through hoops that are sometimes so ridiculous that they just say "forget it". It's not worth it.&lt;br /&gt;&lt;br /&gt;&lt;br /&gt;&lt;br /&gt;They actually asked one client recently who was receiving child support for a 15 year old if that 15 year old would be attending college. Well, we certainly hope so but we can't apply at 15 to make sure we are accepted! Well then, how about sending in the academic transcripts so we can determine if they will be accepted, etc. This seems like big brother looking into our homes and sort of feels like the old days when women could not get financing because they may have a child and would definitely have to stay home and not work!&lt;br /&gt;&lt;br /&gt;&lt;br /&gt;&lt;br /&gt;Where are we heading? Concerned? You're not alone. Food prices ranked just below record-high gasoline prices on the list of things people are worried about.&lt;br /&gt;Here are some simple ways to help save money on food. Time your grocery shopping. With the exception of milk, eggs, and bread, most grocery store products are put on sale at least once every 12 weeks at a significant savings. Stock up on non-perishables when they go on sale. It may take a little planning ahead but it's definitely worth it.  Home cooking is the healthiest and most cost effective method rather than eating out or ordering take-out and it can even take you less time if you plan accordingly. The next time you cook, triple the amount you would normally do and freeze 2/3 of it for later. Then, on those little league game nights or got home from work late nights, a home-cooked (and probably healthier) meal will be waiting in your freezer. Good items to consider freezing are meatloaf, cooked chicken drumsticks, chicken thighs, chicken tenders, homemade meatballs for pasta or swedish meatballs are some of our family favorites! The possibilities are endless.&lt;br /&gt;&lt;br /&gt;Stop buying bottled water.  Recent tests have shown that bottled water and tap water are pretty equal when it comes to safety and taste. Ask your town for a copy of the water quality test if you're concerned. Inventory is starting to shrink and well-priced homes are moving! &lt;br /&gt;&lt;br /&gt;This beautiful listing was priced right and sold in just 6 days!  &lt;br /&gt;&lt;br /&gt;Interest rates fell last week by nearly a quarter of a point on 30-year fixed-rate money -- down to 5.74 percent from 5.98 percent, according to the Mortgage Bankers Association of America. &lt;br /&gt;&lt;br /&gt;New loan applications from purchasers were up by almost 11 percent for conventional conforming loans -- those are the types funded by Fannie Mae and Freddie Mac -- but up by an amazing 21.1 percent for government-backed mortgages, primarily FHA. &lt;br /&gt;&lt;br /&gt;I can hear something stirring out there!&lt;br /&gt;&lt;br /&gt;It certainly looks like it's going to be an active Spring Market. &lt;br /&gt;&lt;br /&gt;Now to represent the entire market...everything is not rosy.&lt;br /&gt;People are worried. They're spending less, and still waiting on the sidelines until they're convinced the market won't go any lower. You don't know it's hit bottom until it starts to rise so....Don't wait. If you can afford the mortgage on that beautiful new home you've been watching...go for it. Just make sure you have a savy "buyer's broker" to help guide you with the pricing and terms. This increase is most likely due to the 30-year fixed rate climbing to 6.27 and then dropping to 5.98. When buyer's saw the rates plummet, they locked in on their purchases.&lt;br /&gt;&lt;br /&gt;&lt;br /&gt;Number Two: The pending home sales didn't decline last month as previous months...they just stayed flat. This is "maybe" an indication that the sales decline has or is bottoming out.&lt;br /&gt; &lt;br /&gt;&lt;br /&gt;Number Three: The Federal Reserve is expected to drop the overnight rates another quarter point next week -- and maybe more in the weeks ahead. &lt;br /&gt;&lt;br /&gt;Well this sounds good to me! Anthony Carr&lt;br /&gt;&lt;br /&gt;&lt;br /&gt;Days on market are dropping, prices have begun an upsurge and multiple contracts have returned. A walk down memory lane? No, just another market turning from buyer to seller in the last few months in the shadow of the White House. &lt;br /&gt;&lt;br /&gt;Arlington County, the first Virginia community across the Potomac River from Washington, D.C., is entering the beginning stages of a seller’s market. In December 2007, the average price for a single-family home jumped 21 percent over a year earlier. &lt;br /&gt;&lt;br /&gt;The local multiple listings service, Metropolitan Regional Information Systems, reports the days on market have been dropping throughout the year, with the average marketing period lasting around 65 days -- nearly half the amount of time for homes to sell in surrounding communities in the Washington, D.C. area. &lt;br /&gt;&lt;br /&gt;By the way, the Capital City itself is leading the way in this recovery with reports from agents of upwards to 70 visitors to open houses and average single family home prices up more than 20 percent. &lt;br /&gt;&lt;br /&gt;Arlington is in the beginning stages of a seller’s market only because there’s still plenty of inventory and the number of homes selling is lagging the previous year. It scared Americans so badly about a possible recession that now we might just have one. Right now the inflation rate (excluding energy and food prices) is at 2.2 percent. Just like every January when we all make our New Year's resolutions..we need to get back to what is really important to us right now. Food, shelter, clothing, family, friends, the necessities. We don't need to give up everything, just the extras we didn't really need anyway. January is a popular time to clean out closets, garages, basements. Organize tax records, etc. Why not take this time to reorganize what's really important to us and stop worrying about all the fluff. If we didn't have so much "stuff" that we just had to have when we bought it..we wouldn't need larger closets, garages, or "STORAGE UNITS" for stuff we haven't seen or used in years.&lt;/div&gt;&lt;br /&gt;&lt;br /&gt;&lt;div&gt;&lt;/div&gt;&lt;br /&gt;&lt;br /&gt;&lt;div&gt;We need to stop the panic. There are some great properties out there at great prices with great interest rates. Investors want the news to continue to be scary so they can keep on buying while sellers would like the news to back off and let us get back to living our lives. Life is what happens while you're waiting for things to change. Today is all we know for sure. If you're waiting for the market to "bottom out" you'll miss your opportunity. The only way to know for sure that the market has bottomed out is when you see it rising. Then you won't have the opportunity to negotiate like you do now...Today is the day to buy that property you've been waiting to buy. That's the best use of the doom and gloom ads. We are all still in the game and yes, it's a game. Today was quoted as the "Best of time and the Worst of Times"...where have we heard that before! &lt;br /&gt;&lt;br /&gt;Yes it's a buyer's Market...Yes it's a seller's market. You need the right marketing specialist to position your property for success and Yes It Can Be Done!&lt;br /&gt;&lt;br /&gt;1855 was the first recorded depression. Those companies and salespoeple who outhustled their competition emerged in a stronger market share &amp; revenue position. Let the others hunker down...The Big R was what it was named then...the big R now stands for RE/MAX! We are RE/MAX are still out there and will continue to be a force to be reckoned with! It means doing what you say you are going to do --no matter what (now there's a concept :o) And for those who maintain accountability in their personal and business lives, there are very real payoffs...&lt;br /&gt;&lt;br /&gt;&lt;strong&gt;"Accountability breeds response-ability"Stephen R. Covey&lt;/strong&gt;&lt;br /&gt;&lt;strong&gt;&lt;br /&gt;&lt;/strong&gt;When you hold yourself accountable, you no longer afford yourself the luxury of blaming others or conditions for your situation. You are in total charge and control.&lt;br /&gt;&lt;br /&gt;The "Golden" resolution for this New Year is to hold yourself totally accountable. The reason this one is golden is because it guarantees success for all your other resolutions.&lt;br /&gt;&lt;br /&gt;2008 is not likely to be a very forgiving year.
